SIBU: The Sessions Court yesterday handed an Indonesian man a jail sentence of 20 years and three months plus four strokes of the cane after he pleaded guilty to raping and illegally entering the country.

Maxi Banfantr, who was unrepresented, admitted to having sexual intercourse with the girl under Section 377CA of the Penal Code and sexually assaulting her sometime in March 2019 in a house in Jalan Hock Ming.

The 30-year-old farmer also admitted to having sexual intercourse with and sexually assaulting the 12-year-old girl last April 22 and 23 in a house at Jalan Kunyit for which he was charged under Section 376 (1) of the Penal Code.

Additionally, Maxi was charged under Section 6 (1) (c) of the Immigration Act 1959/63.

He admitted guilty to this charge and Justice Caroline Bee Majanil sentenced him to three months’ jail for entering the country without a valid travelling document.

According to the facts of the case, the victim’s mother, 45, of Sungai Bidud, had on April 22 found that she was not at home and she suspected that she might have gone out with the accused who was their neighbour.

The next day, she lodged a missing person report.

At about 9am on April 24, the girl’s father saw her at the Paradom Bus Terminal.

She confessed that she had gone out with the suspect and both of them had sex.

This led to the arrest of the accused three hours later on the same day at the central police station where he was earlier detained for not having a travelling document.
