COB to act on JMB requirement from Jan 1

BEGINNING January 1 next year, the Commissioner of Buildings (COB) will begin issuing compounds to developers and strata developments that have not established a Joint Management Body (JMB) within the given time frame.

Deputy Premier Datuk Seri Dr Sim Kui Hian said this move emphasises the government’s commitment to ensuring the proper implementation of the Strata Management Ordinance 2019 (SMO 2019) and the smooth functioning of strata developments across Sarawak.

The ministry responsible for overseeing this process will closely monitor the situation to ensure compliance with the regulations, he said, adding it aims to foster a culture of responsible and efficient management within the strata developments.

Dr Sim made the disclosure while winding up for his Ministry of Public Health, Housing and Local Government at the state legislative assembly here today.

He said a total of 586 strata developments have been approved and completed in Sarawak as of May 19.

“Among these developments, 238 have already been registered with the Land and Survey Department as having established a Management Corporation under Section 21 of the Strata (Subsidiary Titles) Ordinance 2019 (SSTO 2019),” he said.

“This signifies that these developments have taken the necessary steps to manage and maintain their strata properties effectively.

“Furthermore, 74 of the approved developments have successfully conducted their first Annual General Meeting (AGM) to establish a JMB responsible for the day-to-day management of the strata properties.”

These 74 JMBs, he said, have been registered with the Commissioner of Buildings (COB) under Section 18(2) of the SMO 2019.

However, 274 strata developments that are still in the process of submitting their Strata Subdivision Plan (SSP) in compliance with Section 7 of the SMO 2019.

“Once the SSP is submitted and approved, these developments will be able to proceed with calling for their first AGM to establish the JMB.

“Recognising the requests for an extension of time to hold the first AGM of the JMB, the government has granted an extension until December 31 this year, for all remaining strata developments.

“This will provide developers with ample time to complete the necessary procedures and fulfil their obligations,” he explained.
