Court fines two men for injuring, threatening another

KUCHING: The Magistrate’s Court here fined a local man RM1,300 in default of two months in jail for deliberately headbutting a shop assistant at a prominent shopping mall on Jan 13.

Magistrate Siti Farah Ibrahim meted out the sentence against the accused Ozzy, 30, from Kampung Sikuduk after pleading guilty to a charge framed under Section 323 of the Penal Code.

If convicted, the accused can be jailed for a term up to one year or fined up to RM2,000 or both.

According to the charges, he deliberately caused injuries to the 19-year-old victim in a shopping mall at Jalan Tun Datuk Patinggi Haji Ahmad Zaidi Adruce around 10.45am.

Based on the facts of the case, while the complainant was working, he was approached by three unknown men who said they were Bidayuh from Padawan.

One of the men showed a picture of the complainant and asked the complainant if the person in the picture was him or not.

After answering their questions, the accused headbutted the complainant and claimed that the complainant had beaten up their friend at an entertainment centre.

The complainant was then dragged out to the parking area and was forced into the car by the accused but, his action was stopped by the security guard.

As a result of the incident, the complainant suffered injuries to his eyebrows.

Before leaving the scene, one of the accused’s friends named Franley, also warned that he would be looking for the complainant again.

Fearing for his safety, the complainant came forward to lodge a police report which led to the arrest of the accused and one of his friends.

Meanwhile, in a separate courtroom, a friend of the accused named Franley, 29, was fined RM1,500 in default of one month in jail by Magistrate Syarifah Fatimah Azura Wan Ali.

According to the charges, he was charged under Section 506 of the Penal Code for making criminal threats against the same victim.

Insp Mohd Adzmei Ahmad and Insp Nur Syafiqa Nyaie Ilin prosecuted the two cases while the two accused were unrepresented by counsels.
