Duo gets 12 months’ jail each for trespassing

KUCHING: The Magistrates’ Court here sentenced two men to 12 months in jail each after they pleaded guilty to trespassing into a house and stole a laptop and a tablet.

Magistrate Zaiton Anuar meted out the sentence against the accused Jekely Silon, 28, and Jarus Russia, 28, after they made their pleas to the charge under Section 457 of the Penal Code which provides for a jail term of up to 14 years, upon conviction.

Both their sentences were ordered to run concurrently effective from the date of their arrest on Nov 16.

According to the charges, the two accused broke into the house at Jalan Kuching City Mall around 3pm on Nov 14.

During their crime, they stole a Macbook Air laptop and an iPad Pro tablet belonging to a 26-year-old woman.

Based on the facts of the case, the complainant found that her house had been broken into by unknown persons when she arrived home.

Examinations found that several items belonging to the complainant were lost and stolen – namely an identity card, a laptop, a tablet, a wallet and a purse containing a sum of RM1,200 and several ATM cards, and a pair of shoes.

The estimated losses incurred by the complainant is RM5,000.

A police report lodged for further actions, led to the arrest of the two accused at separate locations on Nov 16.

During interrogations, the first accused showed the police where the missing items were hidden, which is in the bushes at Lorong Taman Desa Wira.

As a result of the investigation, the complainant’s CCTV footage also showed that the two accused had broken into the house and stole the victim’s belongings.

Prosecuting officer Merylene Lindan Andrew Mang requested that the two accused be punished appropriately as a lesson.
