KUCHING: An unemployed man who could not take a restaurant owner talking big vented his anger by riding his motorcycle into a dinner table there, causing injuries to the owner.

But unfortunately for Hirman Marty, 40, the law did not see any justification for his action and sentenced him to seven months’ jail and fined him RM1,500 here Monday.

He pleaded guilty to three charges before Magistrate Syarifah Fatimah Azura Wan Ali.

On the first charge, he was charged under Section 506 of the Penal Code with criminally intimidating the 37-year-old man intentionally.

On the second he was charged under Section 324 of the Penal Code with intentionally injuring the same man with a chair, which caused injuries.

Hirman was also charged under Section 427 of the Penal Code for damaging the chair and two dining tables belonging to the man, causing a loss of RM300.

The offences were committed at a restaurant at Pasar Batu 10, at about 12.25 pm on May 7.

Syarifah Fatimah sentenced Hirman to five months imprisonment on the first charge and seven months in prison on the second charge.

The court ordered him  to begin serving his prison sentence with effect from the date of his arrest on May 8.

In addition, Syarifah imposed a fine of RM1,500 or three months in prison on the third charge.

Based on the facts of the case, at the time of the incident, the owner was about to leave his shop when a man suddenly rode up and hit the dining table.

Thereafter Hirman got off the motorcycle and threw the helmet on a table in front of the owner.

He then challenged the owner to a fight outside the premises saying ‘don’t make trouble in Sarawak, this is not Johor Bahru, this is Sarawak, if you make trouble in Sarawak, you will die’.

Hirman also threw a plastic chair at the owner causing injuries to his neck and hands.

However, the owner did not take the bait for fear it would worsen the problem.

He made a police report after Hirman eventually left the scene and police arrested him the next day.

The prosecution of the case was handled by Prosecuting Officer Insp Mohd Adzmei Ahmad while Hirman was not represented by a lawyer.
