Four fined RM3k each for having drug

KUCHING: Four friends were each sentenced to a fine of RM3,000 or two months in jail by the Magistrate’s Court here today for possessing 0.06 grams of Ketamine in a room at an entertainment centre last April.

Accused Boniface Garry Unding Lunyat, 22; Nazri Betty, 28; Rafiq Rayyan Randee Timban, 29, and Timmy Ausell Bennet, 22, each pleaded guilty to one charge which was read together before Magistrate Zubaidah Sharkawi.

Based on the charge sheet, they jointly possessed a drug of Ketamine weighing at 0.06 grams at an entertainment centre in Jalan Tabuan Tranquility at around 1.20am last April 27.

Therefore, all of them are charged in accordance with Section 12(2) of the Dangerous Drugs Act 1952, and can be punished in accordance with Section 12(3) of the same act and read together with Section 34 of the Penal Code.

Upon conviction of the offence, one can be punished with a fine not exceeding RM100,000 or imprisonment not exceeding five years or both.

According to the facts of the case, during the OP of the Entertainment Centre conducted by a police team from the Narcotics Crime Investigation Division of IPD Kuching on April 27, they managed to arrest all the accused who were sitting in a room of the entertainment centre at Jalan Tabuan Tranquility.

As a result of the investigation, the police managed to find a transparent packet containing suspected Ketamine drug powder on the table in the room.

The substance involved has been sent to the Malaysian Chemicals Department and it was later confirmed that it is Ketamine weighing at 0.06 grams.

The prosecution of the case was handled by Prosecuting Officer Inspector Nur Syafiqa Nyaie Ilin while all the accused were not represented by lawyers.
