Housing developers ordered to compensate buyers

KUCHING: Two housing developers were ordered to pay over RM67,000 in compensation by the Sarawak Housing Purchaser Claims Tribunal after failing to complete a number of houses within the stipulated time.

The tribunal’s three-member panel led by president Datuk Maznah Dasmi, and Trabawan Mandi and Mohammad Abdul Aziz Ariffin came to the decision during a hearing at the Kuching Court Complex here on Wednesday (Sept 22).

Maznah said the compensation of RM67,442.51 comprised of five claims – each made by different complainants and the houses involved consisted of five landed properties.

Of these, developer Kajana Sdn Bhd must dish out RM27,112.45 in compensation while fellow developer Jung Kuo Sdn Bhd was ordered to pay RM40,330.06.

“The claimants were initially assured that they had only to wait for two years (to get the houses).

“Those who have received their house keys found that their property had defects.”

Maznah said the defects included unfinished tiles and ceilings, which the developers had agreed to fix.

“So they disputed the case and according to the law, their agreement when purchasing the homes entitled them to be compensated.

“The set compensation was also calculated according to the law.”
