Indonesian male jailed, to be whipped for illegal entry

THE accused is being taken out of the Sessions Court by policeman to the temporary custody of the court before being taken to prison.

KUCHING: An Indonesian man was sentenced to five months in prison and one stroke of the whip by the Sessions Court here for entering the country without any valid travel documents.

Accused Oktavianus, 23, from Singkawang, Indonesia pleaded guilty after a charge was read by an interpreter before Judge Mohd Taufik Mohd@Mohd Yusoff, today.

Taufik ordered the accused to serve a prison sentence with immediate effect from the date of his arrest on November 11 and will be referred to the Malaysian Immigration Department for the purpose of repatriation after serving his prison sentence.

He is charged under Section 6(1)(c) of the Immigration Act 1959/1963 and can be punished under Section 6(3) of the same act.

According to the facts of the case, during an inspection, the accused was detained at a house by a police team on suspicion of committing an offence under the Immigration Act 1959/63 (Amendment 2002).

The investigation found that he was an Indonesian citizen who entered the country without a valid travel document.

In addition, the results of the review at the Malaysian Immigration Department found that there is no valid record of information about the movements of the accused.

The prosecution of the case was handled by Deputy Public Prosecutor Danial Mohamad Ali while the accused was not represented by a lawyer.
