KUCHING: Sarawak Housing Purchaser Claims Tribunal yesterday directed a local property developer to pay a compensation of RM17,232.90 to a house buyer for late delivery.

Datuk Maznah Dasmi assisted by panel members Morni Wahie and Robert Elone Sireng presided over the claim hearing at the old State Legislative Building (DUN) here.

Majelan Sulong received the compensation on a house at Sublot 23 (Survey Lot 3423), Block 17, Salak Land District.

The house was scheduled for completion on Jul 9, 2017 but the Occupancy Permit (OP) was issued on Oct 12, 2018, and the key was handed over on Oct 18, 2018.

Based on the tribunal’s claim formula, the delay was calculated from the scheduled completion date until the date of the OP document.

In this case, the delay was 465 days at RM37.06 per day, making it RM17,232.90 in total.

“The developer, IJK Construction Sdn Bhd, claimed that their development was delayed by the Land and Survey Department. It is the developer’s responsibility to talk to the authorities over matters like this.

“Developers need to evaluate many of the criteria in terms of the weather and the purchase of building materials that can slow down the construction process,” said Maznah who stressed that the compensation must be paid within 45 days after receipt of a letter from the tribunal.
