Lorry driver fined RM1,800 for smashing café’s wall with brick

KUCHING: The Magistrate’s Court today sentenced a lorry driver to a RM1,800 fine or two months in prison for smashing a café’s door wall and signboard with a brick on October 12 at Metrocity Jalan Matang.

The accused,  Nazmi Jem, 39, pleaded guilty to a charge read before Magistrate Syarifah Fatimah Azura Wan Ali under Section 427 of the Penal Code.

According to the allegations, he was accused of willfully damaging the property of a café, resulting in an RM200 loss, in an incident on October 12 at Metrocity, Jalan Matang, about 11.15 a.m.

Conviction can result in imprisonment of no less than one year and no more than five years, as well as a fine or both.

During the incident, the man came to the complainant’s son’s café and threw a piece of brick at the door mirror, but it hit the door wall.

The accused then fled, but was apprehended by one of the workshop workers, who also happens to be the complainant’s son.

The complainant’s loss Is estimated to be roughly RM200.

Following the filing of a police report, the complainant turned over the accused to the police.

The inquiry determined that the accused caused the complainant damage when he chipped the paint on the wall of the café’s door and destroyed two signs as a result of the event.

The case was prosecuted by Prosecuting Officer Inspector Mohd Adzmei Ahmad, and the accused was not represented by a lawyer.
