Mall unit owners seek help over individual title woe

KUCHING: Sarawak United People’s Party (SUPP) Public Complaints Bureau chief Wilfred Yap was recently approached by members of an association comprising purchasers of 73 commercial units at a shopping mall here.

They wanted his help to appeal to the Land and Survey Department to expedite the application for sub-division and issuance of individual strata titles to the units.

According to the members, the mall was completed and occupation permits were issued in 2013 and their properties were delivered to them. However, after six years, the individual subsidiary strata titles to the units have yet to be issued.

This is despite Section 17(1) of the Strata Titles Ordinance 1995, which rules that application for the issuance of separate subsidiary titles should be made within six months after the issuance of occupation permits.

The members said many were unable to secure tenants and many tenants had also vacated the mall because of low crowds. As such, some members are facing difficulties servicing their bank loans. They said without the issuance of individual strata titles, a management corporation comprising owners of units cannot be formed.

They believe that they will be able to contribute their ideas and suggestions through a management corporation in the maintenance and management of the mall to boost its popularity to attract more visitors.

Meanwhile, the bureau has appealed to the Land and Survey Department to expedite the issuance of individual strata titles to alleviate the situation.

The same letter has also been forwarded to Chief Minister Datuk Patinggi Abang Johari Tun Openg and Local Government and Housing Minister Datuk Dr Sim Kui Hian.
