Man, 58, fined RM2,200 for criminal intimidation

SIBU: An elderly man was today fined RM2,200 in default two months’ imprisonment by a Magistrates’ Court here for threatening to cause harm to another person.

Magistrate Mohd Syukri Mokhtar convicted Wong Yik Hee,58, from Bukit Penyau Salim of the offence as charged on his own plea of guilty.

The accused was charged with threatening to cause injury to Hii Hieng Hui, 34, with intent to cause harm to him at Pulau Babi in Jalan Khoo Peng Long on September 30 at about 5.30pm.

The offence, listed under Section 503 of the Penal Code and punishable under the Second Limb to Section 506 of the same Code, provides for a jail term which may extend to seven years or fine or both.

DPP Harvind Raja Gopal who represented the prosecution told the court that on September 30 at about 5.30pm at Pulau Babi, Jalan Khoo Peng Long, Hii (complainant) saw a picture of his friend named “Ah Huat” pasted on the wall of a building and then he removed it.
Then suddenly two Chinese men appeared and one of them known as “Ah Sek” wanted to hit the complainant who managed to flee the scene.

A report was subsequently lodged for further police action.

Acting on information received on the same day at about 9.24pm, a police team led by Inspector Syahmi arrested the accused at Jalan Kampung Nyabor and seized a smart phone from him.

Harvind further told the court that investigation outcome revealed that the complainant accompanied by a friend, was removing posters depicting their friend’s face.

While doing so, the complainant saw the accused approaching who was screaming at him, “I want to hit you” while chasing the complainant and his friend.

Feeling scared, the duo fled the scene.

After realising that the accused was no longer chasing them, the complainant returned to get his van and saw the accused with his friend there.

The complainant saw the accused’s friend flattening both front tyres of his van with a sharp shiny object.

When the accused saw the complainant and his friend approaching, he chased them again but they managed to escape.

The accused who was unrepresented by legal counsel, opted to pay the fine.
