Man fined RM1,200 for slapping luxury car salesperson

KUCHING: The Magistrates’ Court here fined a 36-year-old man RM1,200 in default of one month’s jail after he pleaded guilty to slapping a luxury car dealership head salesperson.

Tan Hern Hua entered the plea today (Oct 25) for a charge framed under Section 323 of the Penal Code before Magistrate Zubaidah Sharkawi.

The Section provides for a jail term up to one year or a fine up to RM2,000 or both, if convicted.

The accused was charged for intentionally injuring the 41-year-old female victim by slapping her left cheek on Oct 15.

The offence was committed at the premises of a luxury car distribution company in Jalan Tun Jugah around 1.15pm.

According to the facts of the case, the accused went to the customer service counter of the premises and scolded the victim.

It was after the accused kept calling the complainant regarding the damage to his car but, the accused’s calls were not answered.

Furious at not being attended to, the accused hit the table and slapped the victim’s left cheek. In fact, the accused also pushed the victim’s head twice using his index finger.

As a result of the incident, the victim’s left cheek was swollen.

It is understood that the cause of the incident was because the accused was not satisfied with the customer service because the luxury car he had just bought, often broke down even though it had been sent for repairs several times.

The victim’s colleagues were the first witnesses to the incident, aside from the CCTV footage at the scene.

Insp Nur Syafiqa Nyaie Ilin prosecuted the case while the accused was unrepresented by counsel.
