Man fined RM1k for making threats to road user

KUCHING: A man was sentenced to a fine of RM1,000 fine or a month in prison by Magistrate’s Court, here yesterday for making threats towards a road user in an incident where the victim refused to give way to him last January.

The accused, Eric Ngelambai, 44, from Kampung Gayau Mawang, Simunjan pleaded guilty on a charge under Section 506 Penal Code that was read before Magistrate Zaiton Anuar.

If convicted, he could be sentenced to two years in prison or fine or both of it.

Based on the charge sheet, he was accused of purposely making threats on the 32-year-old male victim at a traffic light at Tabuan Tranquility at 6.45 am on Jan 20 this year.

According to the facts of the case, during the incident, the accused drove his sedan vehicle heading to the traffic light at Tabuan Tranquility.

The accused then got angry when the victim who drove a compact car immediately entered the right lane from the left.

Because of his anger, he refused to give his way to the victim, and upon arriving at the traffic light, the accused then screamed at the victim by saying “Kamu ada otak ka, kelak pecah kepala” from his own car.

Apart from that, the accused then pointed a weapon to the victim.

When the victim was screamed at, the victim and his wife only said “kamu tidak bertimbang rasa ka” to the accused.

Both the victim and the accused then headed on their own separate ways after the lights turned green.

Fearing for his safety, the victim then made a police report, which led to the arrest of the accused on the same day.

The case was handled by deputy prosecutor Asymawi Ghazali while the accused was not presented by any counsel.
