Man fined RM3,000 for damaging car’s rear windshield

KUCHING: The Magistrates’ Court fined a man RM3,000 for throwing a rubbish bin at a car’s rear windshield, damaging it, after he was not allowed to enter his former sister-in-law’s house.

Aloysius Elvin Martin, 25, pleaded guilty before Magistrate Zaiton Anuar to a charge framed under Section 427 of the Penal Code on yesterday (May 2).

If convicted, the Section provides for a jail term of up to five years or a fine or both.

According to the charge, the accused intentionally damaged the rear windshield of the car belonging to the complainant’s 63-year-old father, causing losses to the tune of RM600.

Aloysius committed the offence in front of a house in Jalan Landeh, Kota Samarahan around 10.30pm on April 27 this year.

Magistrate Zaiton also sentenced the accused to six months’ imprisonment if he failed to pay the fine.

According to the facts of the case, the complainant, who is the accused’s former sister-in-law, was with her boyfriend in the house when they saw Aloysius running amok outside.

He had picked up a rubbish bin and throwing it at the car. As a result, the rear windshield shattered.

The complainant then lodged a police report for further action and it led to Aloysius’ arrest a day after the incident at a house in Jalan Landeh.

It was understood that the cause of the incident was due to the accused’s dissatisfaction when he was not allowed to enter the complainant’s house.

The accused is the brother of the complainant’s husband, who passed away in August last year.

Inspector Merylene Lindan Andrew Mang prosecuted while the accused was unrepresented by legal counsel.
