Man fined RM3,500 for hurting cop

KUCHING: A 45-year-old man was fined RM3,500 after pleading guilty in the Magistrate’s Court here today for injuring a policeman, holding the rank of Lance Corporal, with a cane.

Magistrate Syarifah Fatimah Azura Wan Ali meted out a sentence of five months’ jail for any failure of the accused to pay the fine.

He was charged with intentionally injuring Lance Corporal Sivakumaran Ilangovan, 30, using a cane under Section 324 of the Penal Code.

He committed the offence at a coffee shop in Malihah, here, at about 6.15 pm on May 1, 2020.

If convicted, he can be sentenced to imprisonment of up to 10 years or a fine or whipping or any one of these.

According to the facts of the case, during the incident, the victim was drinking at a coffee shop during the period of the movement control order (MCO).

While the victim and his friend were returning from the coffee shop, the motorcycle ridden by the victim from the opposite direction had collided with the car of the shop owner.

Out of fear, the coffee shop owner (witness) then called the accused to come and help to solve the incident.

Upon arrival at the scene, the victim had provoked the accused which then led to the incident of hitting the victim with a cane.

As a result, the victim suffered head injuries and received treatment at the Sarawak General Hospital. He received three stitches.

The prosecution of the case was led by Deputy Public Prosecutor Jean Siow Chung Hwei while the accused was not represented by a lawyer.
