Man gets 15 months for assault

SIBU: A 27-year-old man will spend the next 15 months in jail after he was convicted of assault by a Magistrates’ Court, today (Aug 2).

Zaipul Engkabang, from Jalan Hua Kiew here, pleaded guilty to the assault charge and the court sentenced him to 12 months’ jail and fined him RM3,000 in default three months’ jail. Since he was unable to pay the fine, he had to serve the default sentence.

Magistrate Mohd Syukri Mohktar convicted him under Section 324 of the Penal Code which provides for a jail term of 10 years imprisonment or fine, or whipping.

The court was told that the accused had voluntarily caused hurt to Jackson Sambang Mathew Maging, 34, with an axe, following an argument at about 4am at Jalan Khoo Peng Long on July 25.

The complainant bled from the wound and fainted at the scene.

Following a police report lodged by the victim the same day, a team of police members led by Insp Azuwan from Criminal Investigation Department Sibu arrested the accused three days later.

The court heard that the complainant was sleeping when Zaipul approached and accused the victim of lodging a police report against his girlfriend for offering prostitution services.

The complainant denied the allegation which led to an argument, prompting Zaipul to swing an axe at the former, hitting him in the neck.

A medical report confirmed the victim suffered deep wounds on the neck and head.
Zaipul was not represented.
