Mechanic gets six months for having, disposing stolen motorcycle

KUCHING: The Magistrate’s Court today sentenced a mechanic to six months in prison for possessing and getting rid of a motorcycle that was stolen by selling its parts.

Magistrate Zaiton Anuar meted out the sentence against Alwin, 36, of Kampung Semeba after he pleaded guilty to two charges under Sections 411 and 414 of the Penal Code.

Zaiton ordered the accused to serve his jail terms for both crimes concurrently effective from the day of his arrest last January 19.

He was accused of having stolen goods in the form of a motorcycle frame that belonged to a 36-year-old man and disposing of it, according to both charge sheets.

Alwin was accused of committing the crime at a house in Kampung Semeba, Batu 5 here at around 11 am on January 19 this year.

According to the case’s facts, the victim found out that someone had stolen his motorcycle on January 16 after leaving it locked in front of the house of a construction worker.

The victim’s loss is believed to be roughly RM2,500.

Subsequently victim filed a police report seeking further action, and the perpetrator was apprehended on January 19 in an Op Lejang operation.

The police confiscated a motorcycle frame, different motorcycle components, workshop building tools, and a receipt for the sale of motorcycle rims during the operation.

Investigations revealed that the accused was in possession of a stolen motorcycle, and a check of the engine chassis number indicated that it was the same as the motorcycle reported stolen by the victim.

The accused also sold the components of the victim’s motorcycle.

Inspector Merylene Lindan Andrew Mang, the prosecuting officer recommended that a deterrent sentence be imposed.
