Men plead not guilty to charges of trespassing

KUCHING: Two men pleaded not guilty to charges of trespassing on Monday (Sept 20).

The accused, Mohd Nabil Syakir Syamim Abdullah, 24, and Irwan Shah Abdul Khalik, 36, appeared before Magistrates’ Court judge Zubaidah Sharkawi.

Mohd Nabil was charged under Section 447 of the Penal Code for trespassing onto the complainant’s yard at Jalan Taman Mawar 8, around 9.30pm on Sept 16.

If convicted, the accused can be sentenced to a maximum jail term of six months or a fine of up to RM3,000 or both.

According to the facts of the case, the complainant saw a dark figure in his yard, went out to investigate, and saw the accused.

The complainant then shouted at the accused while asking what he was doing on his property but the accused only made a hand signal to the complainant to not make any noise.

The complainant and his brother-in-law apprehended the accused and handed him over to the police.

The accused committed an offence under Section 447 of the Penal Code when he admitted to trespassing onto the victim’s property.

In another case, accused Irwan Shah Abdul Khalik, 36, was charged under Section 448 of the Penal Code for breaking into the complainant’s house at Kampung Bintawa Ulu, Petra Jaya around 8.15pm on Sept 15.

If convicted, the accused can be sentenced to a maximum jail term of three years or a fine of up to RM5,000 or both.

According to the facts of the case, the complainant along with his brother apprehended a stranger breaking into their house and they contacted the police for further assistance.

The accused committed an offence under Section 448 of the Penal Code.

The court has set a date for further management of the case to Oct 27 this year.
