Nightclub manager fined for operating without licence

KUCHING: The Magistrate’s Court here today sentenced a nightclub manager to pay a fine of RM4,000 in default four months jail for operating a company without a valid licence.

Harold, 35, pled guilty to one offence under Section 5(1) of the Entertainment Ordinance 2000 and faces punishment under Section 5(3) of the same Ordinance, which was read in front of Magistrate Zubaidah Sharkawi.

According to the charge sheet, Harold, the nightclub manager, was accused of violating the requirements of the Kuching South City Council’s (MBKS) public entertainment licence by operating illegally.

He was accused of committing the offence on Sept 25 at about 11.20pm, at an entertainment centre near Jalan Canna.

If found guilty, he can be fined up to RM20,000 or imprisoned for up to five years, or both.

According to the facts of the case, a police unit from the state’s Criminal Investigation Division conducted an Ops Noda raid at an entertainment centre in Jalan Canna.

The police met with the nightclub manager and requested him to show the business licence, however, he failed to present a business licence or any other related documents.

Failing to present a business licence, the police then seized various equipment, including speakers, microphones, laptops, mixing music players, and music control.

The case was prosecuted by Prosecuting Officer Inspector Nur Syafiqa Nyaie Ilin, and the accused was not represented by a lawyer.
