RMAF personnel gets 10 years for raping girlfriend

KUCHING: A Royal Malaysian Air Force (RMAF) personnel who raped his 13-year-old girlfriend while she was drunk was ordered to serve ten years in prison and endure five lashes of the cane for his crime.

Sessions Court Judge Marutin Pagan on Tuesday handed the punishment to the 31-year-old after finding him guilty.

However, he allowed a stay of sentence pending appeal to the High Court and released him on a bail of RM8,000 with one surety.

The man had stood charged with raping his girlfriend at a hotel in Jalan Abell, between the hours of 2am and 3am on August 31, 2016.

He was charged under Section 376 (1) of the Penal Code which carries a prison sentence of up to 20 years and liable to whipping, if convicted.

The RMAF personnel who was represented by lawyer Abdul Rahman Hazmi requested that he be placed on a good behaviour bond on the grounds that a custodial sentence would affect his life, including his job.

However, Deputy Public Prosecutor Norshafatihah Nor Azmi insisted that the court impose a heavy sentence considering that he had raped the underage victim and taken advantage of her while she was drunk.

Norshafatihah said a good behaviour bond as sentence was not applicable in sexual crime.
