Son who assaulted father while under the influence jailed

KUCHING: A man has been sentenced to three months in prison by the Magistrates’ Court on Tuesday (Aug 22) for assaulting his 71-year-old father during evening prayer.

Azzamuden Sahmat, 27, pleaded guilty before Magistrate Zubaidah Sharkawi to intentionally inflicting painful injuries on his father at their residence in Taman Malihah, Matang, around 8.15pm on July 2.

He was charged under Section 323 of the Penal Code, read together with Section 326A of the same code.

If found guilty, this offence could result in imprisonment for up to one year or a fine of up to RM2,000, or both.

Magistrate Zubaidah ordered the prison sentence to be effective immediately.

Based on the case’s facts, during the complainant’s evening prayer, the accused unexpectedly struck his father’s head against his shoulder three times.

After the prayer, as the complainant was about to stand up, the accused forcefully embraced the father’s neck from behind.

In fear, the father managed to escape to a neighbouring house owned by another of his children.

The incident resulted in pain in the father’s right shoulder and left jawbone.

The complainant was unaware of the reason for his son’s actions, except for his frequent aggressive behaviour.

Concerned for his safety and traumatised, the father reported the incident to the police.

It was revealed that the accused committed the act under the influence of the drug syabu and was unaware of his actions toward his father.

Deputy public prosecutor Inspector Nur Shafiqa Nyaie Ilin requested an appropriate punishment to serve as a lesson to the accused.
