KUCHING: The Sarawak Housing Purchaser Claims Tribunal has ruled a developer responsible in two separate disputes.

Bodco Engineering and Construction Sdn Bhd was liable in the claim over the houses they built in Kota Samarahan.

In the first case, Chia Jun Lee disputed that the developer was to be held responsible over defects in one of their houses, rendering uncomfortable living conditions.

In the second case, Chiew Wan Fatt disputed that the developer delayed the transfer of property to the claimant and claimed for a compensation to be issued.

The three-member panel led by its president Peter Lim Thiam Seng, Robert Elone Sireng and Trabawan Mandi decided that Bodco Engineering and Construction Sdn Bhd would issue a compensation of RM4,059.21 to Chiew.

“At the same time, the developer is instructed by us, ordered by us to make the payment within the period of 45 days from today’s hearing,” Lim told the press yesterday.

In the case of Chia, the panel decided that the developer would perform immediate ratification works and hoped the claimant would continue residing in the house within the same period of 45 days.

“Another case is that the claimant is not claiming for late delivery but pointed out to defects in the building, we ask that the developer rectify the building within 45 days of today’s hearing,” Lim added.

For the year 2019, a total of 40 cases have been solved by the tribunal, 17 of which went into the hearing process and 23 were withdrawn.

Kuching has the highest number of cases with 25, followed by Sibu with nine. Miri and Limbang were tied at three each.

The total of Liquidated Ascertained Damage (LAD) awarded to claimants in 2019 was RM232,059.58 from 13 cases.

Among the type of cases were LAD disputes, defects and a combination of both.
