Used goods dealer fined RM600

KUCHING: The Magistrate’s Court fined a used goods dealer RM600 in default ten days’ jail today for selling used vehicles without a licence in September last year.

Magistrate Syarifah Fatimah Azura Wan Ali meted out the sentence to Ping, 54, after he pleaded guilty to a charge under Section 6 of the Second-hand Dealers Act 1946.

According to the charge document, he was charged with selling used products without a licence at a car premises in Jalan Kuching-Serian at 4.30pm on Sept 29, 2021.

Upon conviction, he is liable to be fined up to RM1,000 or an imprisonment  term of up to three months, or both.

According to the facts of the case, during Op Lusuh, a police team from IPD Padawan had checked a vehicle shop at Kuching-Serian Road, which was found to have failed to comply with the terms of the business licence under the Second-hand Dealers Act 1946.

The accused informed the police during the inspection that the company at the specified address had not been operating for a long time and that the premises had been taken over by the accused.

The results of the investigation conducted against the accused found that he had committed the offence of selling used vehicles without a valid licence.

Based on the investigation, the accused was found to have neglected to exhibit his shoddy goods business licence at his premises.

The accused also admitted that the shop in question was in the process of seeking a licence but had yet to be granted one by the relevant authority.
