10-year-old boy placed on good behaviour bond for stealing ice creams

KUCHING: A 10-year-old boy has been sentenced to a two-year good behaviour bond with a surety of RM50 after pleading guilty to stealing various types of ice creams from a car wash shop in May.

The Magistrates’ Court on today (July 13) ordered the bond under Section 91 (1)(b) of the Children Act 2001 after considering the boy’s character report from the Social Welfare Department (JKM).

Magistrate Syarifah Fatimah Azura Wan Ali also mandated that the parents or guardians of the child attend an interactive programme at the JKM Kuching branch.

The young offender committed the act at a car wash shop in Jalan Sungai Maong Tengah, Jalan Green, around 9.25pm on May 21.

He was charged under Section 380 of the Penal Code, which carries a maximum prison sentence of 10 years and a possible fine upon conviction.

According to the case details, a male complainant noticed that the ice-cream refrigerator placed outside the shop had been opened.

Upon reviewing the closed-circuit camera (CCTV) footage, it was discovered that the boy had climbed over the shop’s fence the previous night and taken ice creams from the refrigerator.

The estimated loss was approximately RM200, leading to a police report being filed and subsequent arrest of the boy on May 22 at around 12.30pm.

The prosecution was handled by ASP Hisyam Junaidi while the accused did not have legal representation.
