Father who carried weapon in public gets good behaviour bond

KUCHING: A father of two was placed on a two-year good behaviour bond by the Sessions Court for possessing a machete in public without a valid reason.

Basare, 45, from Kampung Tabuan Tengah pleaded guilty before judge Mohd Taufik Mohd @ Mohd Yusoff. The charge was framed under Section 6 (1) of the Corrosive and Explosive Substances and Offensive Weapons Act 1958.

If convicted, the accused could be sentenced to jail for a term of up to 10 years and whipping.

Judge Mohd Taufik ordered the accused to be placed on a good behaviour bond for two years with a RM8,000 surety (without deposit) and one surety.

According to the charges, Mohamad Basare carried a 58cm-long weapon in front of a supermarket in Jalan Malihah around 8.30pm last Sunday (Jan 15).

Based on the case brief, a police team from Padawan Criminal Investigation Division (CID) saw a group of men gathering in a suspicious manner.

The complainant (a sergeant) found that one of the men was carrying and holding a machete.

The complainant and other policemen approached the group and told the accused that it was an offence to have a sharp weapon in a public place.

During the arrest, the accused was slightly injured, acting aggressively and struggling with the police thus leading to the use of minimal force to arrest him.

The accused stated that he had no intention of harming anyone with the weapon.

In addition, he appealed for a reduced sentence as he has to support two young children.

DPP Danial Mohamad Ali prosecuted while the accused was unrepresented.
