Five fined RM700 each for causing violent brawl

KUCHING: Five men were each fined RM700 in default one month’s jail by the Magistrate Court here today (May 12) for causing a violent brawl last March.

Norzaimi, 29, Mukhris, 21, Aloysius 24, Razali, 22, and Ozzy, 31, all pleaded guilty to the charge read before Magistrate Zaiton Anuar.

They were involved in causing a violent disturbance in a public place, namely, outside an Arab food restaurant at Jalan Abell, around 4.40 am on March 12.

All the accused were charged under Section 160 of the Penal Code, which provided for a maximum sentence of six months’ jail or a fine of up to RM1,000 or both.

During the incident, the complainant, who was also the first accused (Norzaimi), and three of his friends were eating in the restaurant when a group of men approached and dragged Norzaimi and one of his friends, Ozzy (the seventh accused), accusing them of harassing a member of their group’s younger sibling at a nightclub.

In addition, several of the men also smashed the front window of a car using a golf club and beat one of the complainant’s friends.

A police report was lodged and all five accused were successfully arrested by the police on March 17.

As a result of the investigation, it was found that the fight broke out because the first accused (Norzaimi) owed a debt of ketamine to the third accused, Hafiezi.

The prosecution was handled by Inspector Merylene Lindan Andrew Mang, while all the accused were not represented by lawyers.

Meanwhile, arrest warrants have also been issued for Hafiezi (the third accused) and the sixth accused (Zamrie) for failing to appear in court.
