KUCHING: A foreign labourer claimed trial before the Sessions Court here to a charge of raping a 13-year-old local girl until she became pregnant.
The 26-year-old accused from Sambas, Indonesia pleaded not guilty to a charge under Section 376(1) of the Penal Code before Judge Maris Agan.
According to the charge, he allegedly committed the act in a house in a village at Telaga Air, Matang between Nov and Dec last year.
The accused is liable to be sentenced to jail for a term of up to 20 years and caning, upon conviction.
Maris set the date of re-mention for case management on June 8 pending relevant documents to be prepared for the case under Section 51A of the Criminal Procedure Code (CPC) 1959/1963.
The court also ordered that the accused be remanded until the date of re-mention.
It is understood that a police report was made by a medical officer after the underage victim was found to be two months pregnant during a health check-up.
The accused was then arrested around 11.50 am at a petrol station in Metrocity, Matang on Feb 22.
In his appeal, the accused admitted to have married the victim in Dec last year.
Meanwhile, in the same court, the accused was fined RM10,000 in default of four months in jail for overstaying in Sarawak for three years after his social visit pass expired on Dec 7, 2019.
For the offence, the accused is charged under Section 15 (1)(c) of the Immigration Act 1959/63 punishable according to Section 15 (4) of the same Act.
Upon conviction, the accused is liable to be sentenced to jail for a term of up to five years or a fine up to RM10,000.
DPP Ruvinasini Pandian prosecuted both cases while the accused was unrepresented by a counsel.
