KUCHING: A former civil servant was sentenced to eight years’ imprisonment and two strokes of the rottan after he was found guilty of raping a minor.

Sessions Court Judge Jason Juga found the 49 year old accused guilty on two counts of raping a 16 year old girl five years ago.

The judge ordered the accused to serve the jail sentence from today.

However, in mitigation, the accused’s lawyer, Wit Malang, pleaded for the court to postpone the jail sentence as the accused has to take care of his pregnant daughter who has a heart problem.

The accused also has to support his wife and children, the court was told.

The court then allowed the accused bail of RM20,000 with RM5,000 cash deposit and two sureties while waiting for his appeal to the High Court.

According to the facts of the case, the accused was charged with raping the victim in a store inside a welfare home at Kilometer 19, Kuching-Serian Road at 6.30pm on March 29, 2018.
