Home buyers cry foul over developer’s delay

Home buyers in a photo call demand their houses to be handed over immediately.

KUCHING: House buyers at Borneo Samariang Garden here have urged the developer to immediately hand over the occupational permit (OP) as part of the terms and conditions, set up by the Kuching North City Hall (DBKU).

Home Buyers Terrace 1 Level B23/Phase 5 Borneo Samariang Garden Action Committee, in a statement said that the developers, namely Sentoria Borneo Land Sdn Bhd (SBLSB) or any of its representatives should not take things lightly and show their commitment because it is their responsibility in tandem with the sales and purchase agreement (SPA).

“This housing project has received the Certificate of Practical Completion (CPC) since June of this year, but the application for OP has not being done due to the developers’ failure to comply by DBKU’s terms and conditions.

“We are worried towards its ability to fulfil the agreement that was made on the handover of 154 house units to all of its buyers by this month, per the statement by Minister for Public Health, Housing and Local Government Datuk Seri Dr Sim Kui Hian during the state legislative assembly (DUN) sitting on Dec 1, 2022,” it said.

It then stated the late handover could cause a number of problems, especially to the buyers, due to the needs for them to pay high monthly instalments, from RM800 up to RM1,800 per month.

“Average home buyers right now are between 26 and 45 years old. They have no choice but to pay the high monthly instalments around Kuching and Samarahan that are now up to RM2,500 per month.

“We were supposed to receive our home between 2019 and 2020 but up to this day we are still waiting.

“With higher cost of living these days, we believe some of the home buyers would end up bankrupt for not being able to pay these month’s instalments.

“We once again want the state government to push the developers to comply by the terms and conditions from DBKU,” it said.

The committee does not want the developers to not take the projects seriously as the project is in the final phase.

“We reject it whole heartedly and will not agree on any form of delay for the handover by the developers after this month,” it added.
