It pays not to drive under influence of alcohol

SIBU: A 48-year-old man who drove under the influence of alcohol was sentenced to a day’s imprisonment and fined RM10,000, in default, five months’ jail by the Magistrates’ Court yesterday (Feb 17).

Magistrate Mohd Syukri Mokhtar also ordered that the accused be disqualified from holding or obtaining a driving licence for two years.

Kong Chun Nei from Jalan Siol pleaded guilty to the charge framed under Section 45A(1) of the Road Transport Act 1987 which provides for a jail term of not exceeding two years and a fine not less than RM10,000 and not more than RM30,000 as well as disqualification from holding or obtaining a driving licence for a period of not less than two years from the date of conviction.

Kong was accused of driving with so much alcohol in his body that the proportion of 64MG/100ML exceeded the prescribed limit of 50MG/100ML in his body.

He committed the offence at Channel Road at 11.56pm on Jan 28.

In outlining the brief facts of the case, Deputy public prosecutor Muhamad Ali Hussain told the court that on Jan 28 at around 11.56pm, the accused while driving a car at Channel Road was stopped for checking by a traffic police team led by ASP Mohd Azlizi.

Upon inspection, he was detected with alcohol from his breath, and was then tested using the SD-2+ TOOL on the spot and he tested positive with a reading at 73MG/100ML.

Further test using EBA II at the Sibu traffic police station confirmed the first reading dropped to 64MG/100ML in the blood and this still exceeded the prescribed limit of 50MG of alcohol in 100ML in the blood, as outlined under Section 45G (1)(B) Amendments 2020 of the Road Transport Act 1987.

Kong pleaded for leniency and opted to pay the fine.
