Len Talif explains reasons for title deed delays

A TOTAL number of 183 land subdivision and condition change projects or Application for Variation of Title Condition (AVTC) are currently awaiting the issuance of title deeds.

Deputy Minister of Natural Resources and Urban Development, Datuk Len Talif Salleh said the outstanding premiums for these amount to RM55.5 million.

“The delay in obtaining the title deeds is primarily attributed to the non-sealing of the Memorandum of Surrender and Alienation (MOSA) or Memorandum of Surrender and Re-alienation (MOSRA), as well as the failure of project developers to fulfil their financial obligations, including land premiums and associated fees.

“Leading the tally as of April 30, Kuching has 104 projects consisting of 2,779 lots awaiting title deeds.

“The outstanding premiums and fees for these projects amount to RM39.7 million,” he said.

“Sibu Division follows suit with 41 projects comprising 1,021 lots, totaling RM12 million in premiums and RM43,000 in outstanding fees,” he said.

He said this in a press conference in relation to a question raised by Bukit Assek assemblyman Chieng Jik Ek during the question-and-answer session earlier at the DUN on Tuesday (May 16).

“Other regions with pending title deeds include Sri Aman with 10 projects totaling RM541,067 in premiums and fees, Miri with eight projects amounting to RM510,964, Sarikei with seven projects totaling RM233,424, Limbang with four projects amounting to RM189,587, Samarahan with three projects totaling RM1 million, Mukah with two projects totaling RM43,280, Serian with two projects amounting to RM643,867, and Kapit and Bintulu each with one project totaling RM6,696 and RM528,981, respectively,” he said.

He said landowners and developers must complete the MOSA or MOSRA process, in addition to settling enhanced premiums, land tax, and other relevant fees before the issuance of title deeds can be facilitated.

According to the customer service charter, he said, the Land and Survey Department aims to issue the title deeds within approximately 56 days from the submission date of MOSA or MOSRA, along with the payment of premiums and related fees by landowners or developers.

Regarding the Bukit Assek constituency, he said five projects involving 447 lots have already been issued with Occupation Permits (OP) and Road Certificates but are still awaiting the issuance of title deeds. These projects encompass 333 residential lots, 100 commercial lots, and 14 industrial lots.

“The Land and Survey Department has called on landowners and developers to collaborate and take prompt action in finalising the sealing and return of MOSA and MOSRA documents, as well as fulfilling all necessary payments.

“These steps are crucial prerequisites for the successful issuance of title deeds,” said Len Talif.
