Man gets eight months in prison for housebreaking, theft

KUCHING: A 34-year-old man was sentenced to eight months in prison by the Magistrates’ Court here for breaking into a house and stealing four bags.

Azlan pleaded guilty on Monday (May 8) to a charge under Section 457 of the Penal Code, which was read by an interpreter before Magistrate Syarifah Fatimah Azura Wan Ali.

According to the charge, the accused broke into the house of a 39-year-old man in Jalan Batu Kawa at around 5.30am, Sept 28, 2022, and stole four bags.

If convicted, the accused faced a jail term of up to 14 years and a fine.

As for the second or subsequent offences, the accused can be fined or caned.

Based on the facts of the case, the complainant realised that his house had been broken into by an unknown man through the back window.

The complainant then went downstairs and found that the accused had run away with three of the complainant’s bags and one handbag which belonged to his wife.

The complainant managed to chase after the man and shouted to the security guard for help, who managed to retrieve all his bags from the accused.

However, the accused managed to escape after elbowing one of the security guards.

Further inspections found that the complainant’s bag, which had RM1,000 in cash, had gone missing.

The complainant then made a police report for further action which led to the arrest of the accused on the same day.

Inspector Mohd Adzmei Ahmad prosecuted the case while the accused was not represented by legal counsel.
