Man gets three months imprisonment for damaging SUV

SIBU: A man was fined RM3,000, in default three months’ jail, by the Magistrates’ Court for committing mischief.

Magistrate Punitha Sivaraji handed down the sentence after Rahmat Abdullah, 44, pleaded guilty.

The accused was charged with damaging the front windscreen of a Perodua Kembara SUV parked by the roadside of Kampung Hilir between 5.30pm and 11.10pm on July 10.

The offence is listed under Section 425 of Penal Code and punishable under Section 426 of the same Code which upon conviction, provides for a jail term of not less than one year and not more than five years, or fine or both.

The court was told that at about 11.10pm on July 10, the complainant, aged 33, found the front windscreen of his vehicle smashed.

He had checked his vehicle earlier at about 5.30pm, and it was undamaged then.

At about 9pm the same day, about 50m from where the vehicle was parked, the accused had warned the complainant, saying: ” I will break your car’s windscreen.”

Acting on information received, police arrested the accused the early the following morning for questioning.

The accused admitted that he used a piece of wood to smash the complainant’s vehicle.

Rahmat, who was not represented by legal counsel, was ordered to serve the jail term as he could not pay the fine.
