KUCHING: The Magistrate’s Court here today sentenced a local man to six months in prison for possessing a stolen property, specifically a car tyre, which was stolen last Wednesday (October 11).

Shah Rizal Mohamad Talib, 40, pleaded guilty to the charge under Section 411 of the Penal Code, read before Magistrate Zubaidah Sharkawi.

Zubaidah ordered the defendant to begin his prison sentence immediately.

According to the charge, he allegedly committed the offence at a house in Kampung Gersik, Petra Jaya, around 3.30 in the afternoon on October 11.

If found guilty, he could have been sentenced to up to five years in prison, a fine, or both.

According to the facts of the case, the complainant, who is the owner of the car, discovered that one of the car’s tyres, which was parked in a public parking area, had been stolen.

The complainant then filed a police report, which prompted further investigation and led to the arrest of the defendant a day after the incident.

Upon arrest, the police also confiscated several tools believed to be used in tyre theft, including a rim unit, two car jacks, and tyre screws.

The investigation revealed that the defendant had in his possession a car tyre that had been reported missing by the complainant. Furthermore, the complainant confirmed that the tyre was his.

Deputy Public Prosecutor Inspector Nur Shafiqa Nyaie Ilin requested the court to impose an appropriate sentence as a lesson for the defendant.
