Reliable evidence crucial to Tribunal claims

SIBU: The Consumer Claims Tribunal on Monday dismissed a houseowner’s claim after he failed to show evidence that the tiles he had bought from a company were defective.

Its president, Timothy Finlayson Joel, who presided over the case on Sept 5, said the claimant, Ling Hang Wee, had did not provide any reliable evidence when claiming for compensation.

“Though the claimant had provided photos and supporting documents to claim a refund of 50 per cent for defective tiles, he had failed to show rebuttal evidence to the manufacturer’s feedback.

“It should be noted that parties must be ready with reliable evidence when coming to the Tribunal and the claimant must be ready to contradict the manufacturer’s feedback which said the tiles were without any defect,” he said.

He also noted that the choice of the tiles was made by the contractor who completed the laying of the tiles.

Hence, Timothy said the case has to be dismissed as the claimant had failed to make a case on the balance of probability.

In another case, he asked a claimant, Salmah Mohd Ali, to provide the Tribunal with the correct address of the respondent to whom she had sent a letter about not receiving the air purifier which she had bought.

Salmah told the Tribunal that sometime in April this year, a leading water, air and home wellness company had held a promotion on their items.

“As I was interested, I bought an air purifier for RM2,000. I was told that they will send me the item two weeks after my payment.

“But until now I have yet to receive it and they have also blocked my number,” she claimed.
