Security guard fined for punching motorist

KUCHING: A security guard who took the law into his own hands and punched a motorist in the eye over a parking dispute was fined RM1,800 fine or spend two months in prison here.

Magistrate Syarifah Fatimah Azura Wan Ali handed Derrick, 26, the penalty on Tuesday.

He was charged with intentionally injuring the 33-year-old motorist at the Jalan Song shopping centre’s loading area around 4pm on Sept 5.

According to the facts of the case, the motorist had parked his sedan car at the shopping centre’s loading area to deliver fruits to a supermarket there.

When the motorist returned to the loading zone, he saw that one of his car’s wheels had been clamped.

He then proceeded to the security guard’s room to get it removed but he was told that the loading bay was reserved for trucks and lorries and that if he wanted to unlock the clamp, he would have to pay a RM200 fine.

The motorist, who was dissatisfied since he believed he had parked the vehicle correctly, thereafter purchased a key cutting tool to cut the clamp.

And while he was at it, Derrick came over and punched him in the left eye causing him to collapse.

The impact broke his spectacles, injuring his eye which later needed several stitches at a private hospital.

The case was prosecuted by Inspector Mohd Adzmei Ahmad while Derrick was not represented.
