Tribunal orders developer to explain Late Delivery Penalty to buyer

KUCHING: The Sarawak House Buyers Claims Tribunal (TTPRS) directed Data Majestic Sdn Bhd to provide an explanation for a Late Delivery Penalty (LAD) case amounting to RM19,660.10 to the buyer today (April 24).

Buyer Charlie Lawai had signed a sale and purchase agreement for a single-storey corner terrace house on Oct 1, 2018, with the occupancy permit (OP) scheduled for June 21, 2023, and vacant possession to be handed over to the owner on Aug 24, 2023.

However, the developer failed to deliver the said house as per the agreement.

TTPRS president Trabawan Mandi stated that the claim must be settled within 45 days from today’s date.

“If the penalty is not explained, the developer must pay the penalty and interest at a rate of eight per cent per annum to the buyer.”

Trabawan said so in a media session after the TTPRS hearing session at the TTPRS Court here.

He added that there were five hearings of LAD claim cases on Wednesday, but four of them were rescheduled for another date.

Meanwhile, Trabawan revealed that they also received several claims from buyers against Sentoria Borneo Land Sdn Bhd.

The hearing was attended by two panel members, Mohammad Abdul Aziz Ariffin and Robert Elone Sireng.
