Two foreigners jailed four months for overstaying

KUCHING: Two foreigners were each sentenced to four months’ jail by the Sessions Court yesterday, for overstaying and for being in the country without valid travel documents early this month.

The accused Dicky Derian, 24, from Singkawang, Kalimantan-Indonesia pleaded guilty to charges under Section 15(1)(c) of the Immigration Act 1959/63 and can be punished under Section 15(4) of the same act which provides for a fine of up to RM10,000 and imprisonment up to five years or both, if convicted.

Judge Mohd Taufik Mohd @ Mohd Yusoff sentenced Dicky to four months in prison and was referred to the Malaysian Immigration Department after serving his sentence.

In another case, Robert Pardede, 29, also from Singkawang was sentenced to four months in prison and one stroke of the cane by Judge Musli Abdul Hamid after pleading guilty to entering Sarawak without a valid travel document.

Robert was charged under Section 6(1)(c) of the Immigration Act 1959/63, punishable under Section 6(3) of the same act, which carries a fine of not less than RM10,000 or imprisonment of not more than five years or both if convicted.

The court also ordered the accused to be referred to the Malaysian Immigration Department after serving his sentence for deportation.

According to the charges, they jointly committed an offence at a restaurant in Taman Desa Bumiko, Batu Kawa, at about 5.05 pm on Dec 1.

Meanwhile, the two accused were each sentenced to four months in prison at the Magistrate Court for being involved in online gambling.

They confessed to Magistrate Syarifah Fatimah Azura Wan Ali for charges under Section 4B(a) of the Common Gaming Houses Act 1953.

According to the facts of the case, the police raided a restaurant in Taman Desa Bumiko because it was believed there was online gambling activity and arrested two foreign men.

During the inspection, the police found that Dicky’s social visit pass had expired while Robert failed to present any valid travel documents.

In addition, some online gambling devices were also seized by the police.

The prosecution is handled by two Deputy Public Prosecutors Danial Mohamad Ali, and Norshafatihah Nor Azmi, and Prosecuting Officer Inspector Mohd Adzmei Ahmad.
