Café bistro caretaker fined RM3,000 for operating without license

KUCHING: The Magistrate’s Court fined a local woman RM3,000 in default of three months’ imprisonment for operating an entertainment centre without a license in Batu Kawa.

Simaran Kaur Gill, 56, who worked as the premises’ caretaker pleaded guilty before Magistrate Zubaidah Sharkawi to a charge framed under Section 5 (1) of the Entertainment Ordinance 2000.

According to the charge, she was accused of committing the offence at a cafe and bistro premises in Jalan Batu Kawa at around 4 am last July 16.

If convicted, Simaran can be fined up to RM20,000 or jailed for a term of up to five years or both.

Based on the facts of the case, a raid was carried out at the premises by Padawan Criminal Investigation Division (CID) as it was believed to be running an entertainment centre without a license from the local authorities.

The police also arrested Simaran who failed to produce a valid entertainment centre business license.

Checks by the Padawan Municipal Council confirmed that the premises belonging to the husband of the accused did not have an entertainment license to carry out such an activity.

Insp Nur Syafiqa Nyaie Ilin prosecuted the case while the accused was unrepresented by a counsel.
