Dockyard company fined for failing to report workplace death

SIBU: The Magistrates’ Court on Monday (Nov 8) fined a dockyard company RM3,000 for failing to submit a death report incident of its employee to the Department of Occupational Safety and Health () within the prescribed period.

The fine was imposed by Magistrate Mohd Syukri Mokhtar who presided over the case.

According to the charge referred against the company, at as an employer on Dec 26, 2018 at about 5.30pm at its dockyard in Jalan Maling, Sungai Maaw had failed to submit report within seven days regarding a death incident which occurred on Dec 18, 2018 in JKKP (DOSH) form 6 to the nearest DOSH office which involved its employee’s death following a fall from a ship under maintenance work.

Thus, the company violated the 5 (1)(a)9bb) of Occupational Safety and Health (Notification of accidents, dangerous occurrences, occupational poisoning) and occupational diseases) Regulations 2004 which provides a fine of  up to RM10,000 or one year’s jail or both.

According to facts of the case tendered by prosecuting officer Frank Murphy Junaidi Kutoi of Sarawak DOSH, on Dec 20 at about 8am, the Sibu branch of DOSH received a death accident complaint which involved the victim, Wong Chung Ching, 72, which occurred on Dec 18 at about 5pm due to fall from a a ship under maintenance at the company’s dockyard in Jalan Tanjung Maling, Sungai Maaw.

On Dec 20 at about 11am, a team of officers from DOSH went to the the scene of accident to investigate.

Investigation  revealed that a death incident had occurred at the material time which involved the victim Wong Chung Ching, who is captain of the ship under maintenance work at the dockyard.
