Five fined RM800 each for scuffling

SIBU: Five men aged between 29 and 50 were each fined RM800 in default two weeks’ imprisonment by a Magistrate’s Court here for brawling today (26 Aug).

Magistrate Mohd Syukri Mokhtar passed down the sentence after the accused understood and pleaded no contest to the joint charge against them.

Yii, 34, from Jalan Jeruwit Timur; Tiong, 44, from Ulu Sg Merah; Ngo, 42, from Jln Aup Lama; Hi, 50, from Jalan Salim and Tang, 29, of Jln Tekam were indicted under Section 160 of the Penal Code which upon conviction, provides for up to six months’ imprisonment or RM1,000 fine or both.

According to the charge sheet, they were found committing affray at the corridor of a cafe in Jalan Sena on August 21 at around 12.30am.

In outlining the facts of the case, Deputy Public Prosecutor (DPP) Heng Yi Min told the Court that on August 21 at around 11am, while Insp Hairul Hussin was in his office, a video recording was seen on Facebook social media in “Sibu Info” which lasted 0.42 seconds.

In recording it was written “Sibu Group Fight” at the location last night and the video was recorded by a member of the public. So far the cause of the fight was still unknown.

On the same day at about 2.15pm, Insp Hairul together with a police team arrested five suspects involved in the fight for investigation purposes.

As a result of the investigation, it was found that all the suspects suffered injuries.

DPP Heng further told the Court that based on the CCTV camera recording at the place, it was revealed that all the five accused and several unidentified men were found to be involved in a group fight at the corridor of the cafe.

“From the CCTV recording, all the five accused can be positively identified to be persons involved in the group fight at a public place.

“Therefore, all the accused had committed an offence under Section 160 of the Penal Code for committing affray in a public place,” DPP Heng added.
All the accused, who were represented by legal counsel, paid their fines.
