Peace bond for duo involved in homeless individual’s dispute

KUCHING: The Magistrates’ Court has directed two men to maintain peace for six months following a dispute arising from the relocation of boxes belonging to a homeless individual.

Magistrate Mason Jaro Lenya Barayan imposed the order on Tan Kuok Chung, 48, and Mohd Nezzary Abdullah, 52, after they pleaded guilty to a charge under Section 67 of the Criminal Procedure Code.

The case stemmed from an incident where Tan reported to the police about being assaulted, alleging a rib injury, purportedly caused by unidentified individuals at his parents’ residence in Jalan Ellis here around 11pm on Feb 29.

However, police investigations revealed that Tan’s injury resulted from a confrontation initiated by him after removing boxes belonging to a homeless individual named Alobo from an unoccupied residence.
Nezzary, whom Alobo sought assistance from, became involved in the dispute, leading to a physical altercation.

Magistrate Mason Jaro, in an effort to mitigate further conflicts, ordered both parties, who have been long-term residents in the same neighbourhood, to observe a six-month peace bond. The bond includes a RM500 guarantee provided by a local surety.

Prosecuting the case was Insp Merylene Lindan Andrew Mang, while neither Tan nor Nezzary were represented by counsel.
