Baseball hit leaves man with RM5k fine

KUCHING: A mechanic, 51, was fined RM5,000 by the Magistrates’ Court in default of five months’ jail for injuring a man with a baseball bat during a road rage incident on February 25.

Magistrate Sandy Yvette Freddy sentenced the accused known as Chang Sze Ping, on his own guilty plea to a charge read before her under Section 324 of the Penal Code, which provides up to five years in prison, or a fine, or caning, or both.

Based on the fact of the case, the accused injured a 20-year-old male victim with a baseball bat on Feb 25 at around 10.40 pm on the road in front of a factory in Padawan here.

According to the case facts, it was revealed that while at the traffic lights in front of the factory, the accused had asked the complainant to stop his vehicle.

When the traffic lights turned green, the accused rammed into the complainant’s vehicle until the complainant had to stop by the side of the road.

Later on after that, the accused got out of his vehicle and proceeded to hit the complainant with a baseball bat five times on the head and once on the leg.

The complainant became unconscious at the scene and experiencing minor injuries on his eyebrows and the back of his head and swelling on his left finger and right foot.

He then went for treatment at a hospital and lodged a police report which led to the accused’s arrest on Feb 27.

Further investigations revealed that the complainant had been driving recklessly, causing the accused’s car to almost crash.

Such incident caused the accused to be angry and proceeded to chase after the complainant’s car and beat him up with the baseball bat.

The prosecutor of the case was Insp Mohd Adzmei Ahmad while the accused was not represented.
