Court fixes Feb 3 for hearing

PETRONAS’ APPLICATION FOR JUDICIAL REVIEW

KUCHING: The High Court here yesterday fixed Feb 3 to 5 this year to hear the application by Petronas for a judicial review to declare that the State Sales Tax (SST) imposed by the Sarawak government has contravened the Federal Constitution, and is therefore null and void.

The dates were fixed by Judge Azahari Kamal Ramli after hearing the application by the lead counsel for Petronas, Datuk Malik Imtiaz Sarwar.

When met by reporters later, Malik said Petronas is seeking a court declaration that Sarawak’s SST comptroller did not have the authority, and made errors of law in issuing the sales tax notices to the company. 

“If (the court decides that) we are right, those notices (to demand for the SST payments) should be quashed. That is what we are asking for,” he said. – Bernama
