Jobless man gets one year in prison, RM1k fine for theft, burglary

KUCHING: An unemployed man was sentenced to one year in prison and fined RM1,000 by the Magistrates’ Court for the theft of a motorcycle and burglary of a woman’s bedroom in early February.

Norhaizammer, 23,  pleaded guilty to two charges presented before separate magistrates today (Feb 15).

On the initial charge, he was accused of stealing a Yamaha motorcycle owned by a 27-year-old man behind a 24-hour convenience store, Metrocity, Matang, around 2.10am on Feb 6.

Consequently, he faced charges under Section 379A of the Penal Code, carrying a punishment of imprisonment for not less than one year and not exceeding seven years, with the possibility of a fine if found guilty.

Magistrate Syarifah Fatimah Azura Wan Ali imposed a one-year prison sentence on the accused.

On the second charge, Norhaizammer was accused under Section 448 of the Penal Code for burglarising a 24-year-old woman’s bedroom in a house at Kampung Sungai Midin, Semariang Semerah Padi, around 3.15pm on Feb 9.

Magistrate Zubaidah Sharkawi imposed a fine of RM1,000, in default two months’ imprisonment, on Norhaizammer.

According to the case details, the male complainant reported on Feb 7 that his motorcycle, parked behind a 24-hour convenience store in Metrocity, Matang, had been stolen. A police report estimated the loss at around RM1,500.

In a separate incident on Feb 9, the female complainant reported waking up to an unfamiliar man in her bedroom in a suspicious manner.

Seeking help from her siblings, she removed the man from her room and handed him over to the police for further action and investigation.

Based on witness statements and CCTV footage, the investigation into both cases revealed that Norhaizammer stole the motorcycle on Feb 6 and was also found to have been in the woman’s house without permission with the intention of committing a crime.

The prosecution was handled by two Prosecuting Officers, Inspector Nur Shafiqa Nyaie Ilin and Inspector Ammarsoffi Yusoff, while the accused was not represented by a lawyer.
