KUCHING: A man was sentenced to six months in prison and two lashes by the Sessions Court today after beating his brother with a broom stick, leaving the latter injured.

Judge Afidah Abdul Rahman sentenced Ajun Harmono Yatni, 35, after pleading guilty to a charge under Section 324 of the Penal Code read together with Section 326A of the same code.

Based on the charge sheet, he was charged with intentionally causing injury to his 47-year-old brother using a weapon which was a broom stick measuring 111.5 centimetres at their residence in Kampung Pejiru, Bau, at around 11.30am on June 6.

If convicted, can be punished with imprisonment up to ten years or fine or caned, or any of the two punishments.

According to the facts of the case, the accused acted aggressively by throwing household appliances onto the road in addition to disrupting the movement of vehicles passing by in the area of the incident.

The victim and other family members tried to calm down the accused but he punched the victim and hit the victim with a broom stick several times on the back of the victim’s body.

Due to the incident, the victim suffered pain and minor injuries in the body.

The victim made a police report for further action leading to the arrest of the accused at approximately 4.30pm.

Before being sentenced, the accused pleaded for a reduced sentence because it was his first offense and promised not to repeat the offense involved.

Deputy Public Prosecutor Mohamad Aiman Mutallib Mohamad Shariff requested that the accused be given a severe punishment commensurate with the offense committed, taking into account the public interest and the relationship between the accused and the victim.
