Restaurant worker fined for recording video of man defecating

KUCHING: A homosexual man was fined RM2,500 in default of five months in jail by the Magistrate’s Court for recording an 18-second video of a man defecating in a public toilet at a shopping centre.

The accused Raychai, 29, a restaurant worker, pleaded guilty to a charge under Section 509 of the Penal Code which was read by an interpreter before Magistrate Zaiton Anuar today.

According to the charge, he is accused of recording a 19-year-old man defecating in a public toilet at a shopping centre at around 1.19 pm last Monday (June 12).

Based on the facts of the case, at the time of the incident, the victim, who is a student, was defecating and a hand was seen holding a smartphone taking pictures or recording videos.

The victim then came out of the toilet by coincidence, met a security guard in the toilet and informed him about the incident.

After that, the security guard proceeded to arrest Raychai and then lodged a police report.

As a result of the investigation, the accused admitted to recording the video and is interested in men.

The smartphone was also handed over by himself to the police as evidence of the incident.

The prosecution of the case was handled by Prosecuting Officer Inspector Merylene Lindan Andrew Mang while the accused was not represented by a counsel.
