Salesman fined RM15k for selling unregistered product

SIBU: A 35-year-old man was fined a total of RM15,000 by the Sessions Court here yesterday on three charges of violating the Sale of Drugs Act 1952.

Sessions Court Judge Marutin Pagan convicted Wong Chung Kiat after he pleaded no contest to the charges.

In handing down the sentence, Marutin fined Wong RM5,000, in default, one month’s jail for each charge.

On the first charge, Wong was found to have sold one box of ‘Kiyome Kinoki Cleansing Detox Foot Pads’ which is not registered product through Mastura Junaidi to Lian Minggu Dana at his business outlet in Star Mega Mall on Dec 1 last year.

The second charge stated he was found to have in his possession for sale, seven boxes of ‘Kiyome Kinoki Cleansing Detox Foot Pads’ which is not registered product at the same venue at about 11am on Dec 1 last year.

For the third charge, he was found having in his possession two articles which are not notified cosmetics at the same venue and time.

All the offences are listed under the Control of Drugs and Cosmetics Regulations 1984 and punishable under Section 12(1) of the Sale of Drugs Act 1952 which provides for a fine of up to RM25,000 or three years’ imprisonment or both and for second or subsequent offences be liable to a fine upon conviction up to RM50,000 or five years’ imprisonment or both.

Wong, who was not represented by legal counsel, opted to pay the fine.
