KUCHING: The Magistrate’s Court here yesterday acquitted a police officer charged with distributing 5.6kg of marijuana.

Magistrate Syarifah Fatimah Azura Wan Ali ordered that the accused, Aizat, 30, be discharged and acquitted after the prosecution withdrew the case.

The court was told that the chemical report presented did not contain drugs in all the bottles of juice allegedly mixed with cannabis that were seized from the luggage of the accused when he was detained at the Kuching International Airport (KIA) international arrival hall earlier this year.

Thus, the prosecution withdrew the case against the accused after finding that there were no elements that could charge him in accordance with Section 39B(1)(a) of the Dangerous Drugs Act 1952.

The Act provides for a sentence of death by hanging or life imprisonment and subjected to not less than 15 lashes.

Aizat was charged with possessing the prohibited substance when he arrived at KIA, around 10.10pm, on Jan 2.
